Polar Bear Rentals - Terms and Conditions

 

It is simple. We charge a daily rate. Our charges are as follows:

 

• We have a 25% fully refundable security deposit, and a 50% deposit to book a date. We also accept a blank signed cheque that will be given back to the client as security for the security deposit.
• We deliver and collect all the rentable products. We are qualified refrigeration technicians so we know how to install and transport equipment. We charge per kilometer to collect and install. All the electrical requirements are indicated with all our products on the product page.
• When booking dates, a rental agreement contract must be completed with a copy of the clients ID

 

Rental Agreement

 

AGREEMENT FOR THE RENTAL OF EQUIPMENT

1. The customer hereby rents from the company, which hereby rents to the customer, the

equipment set out in the schedule which forms part of this agreement.

 

2. Unless the company in its sole discretion agrees otherwise, delivery of the equipment to and collection of the equipment from the customer shall only be undertaken by the company.

 

3. The customer shall not under any circumstances be entitled to move the equipment without the written consent of the company.

 

4. The company will make reasonable efforts to meet the customer’s delivery requirements, but all delivery times are estimates only and no liability shall attach to the company for any failure to meet such requirements, nor shall the customer be relieved of any obligation to accept the equipment or pay rental for the equipment by reason of any delay in delivery.

 

5. The customer shall be obliged to take delivery of the equipment at the premises where they are to be installed or at the agreed delivery address.

 

6. Unless the customer or the designated representative of the customer accepts delivery under signature, the company shall not be obliged to then effect delivery, and in this event the following shall apply:-

6.1. Delivery shall thereafter be effected at the company’s discretion, and

6.2. The period of rental shall nevertheless commence from the original agreed delivery date.

 

7. All wasted delivery costs and any charges for storage, whether at the company’s premises or not, occasioned by the customer’s failure to accept delivery once agreed, shall be paid by the customer on demand.

 

8. Any additional costs incurred by the company caused by any unforeseen impediment to delivery, including but not limited to remote location, narrow/steep stairs, inadequate elevators, blocked access points and the like, shall be paid by the customer on demand.

 

9. Collection shall be on the agreed collection date specified in this agreement or on such later date as shall be agreed upon by the parties in writing.

 

10. The period of rental shall commence on the original delivery date and shall terminate on the date that the equipment is collected by the company, both days to be inclusive.

 

11. Ownership in the equipment shall at all times remain vested in the company.

 

12. In the event that the equipment is delivered to the customer at any premises which are rented by the customer, the customer shall be obliged to advise the lessor of such premises that the equipment is owned by the company, and the equipment shall thereby not be subject to any landlord’s hypothec.

 

13. On the collection date, the company shall collect the equipment from the agreed delivery address. The customer hereby irrevocably authorises the company or its agents to collect the equipment, and if necessary to detach the equipment from anything to which it is attached, installed or annexed, and to enter into any premises where the equipment is situate for these purposes. The company shall not be liable for any damage caused thereby, and the customer hereby indemnifies and holds the company harmless against all or any claims made against the company or its agents arising out of such collection.

 

14. The customer acknowledges that it has taken delivery of the equipment in full and good working order and condition and shall return the equipment to the company in the same good working order and condition as received.

 

15. The customer shall be solely liable for all risk of loss in and damage to the equipment from whatsoever cause and howsoever arising, from the time of delivery thereof until collected by the company.

 

16. The customer shall be obliged to effect comprehensive insurance cover in respect of the equipment for the period of rental.

 

17. The customer hereby indemnifies and holds the company harmless against any and all loss, damage or claims, of whatsoever nature arising from the customer's rental of the equipment.

 

18. The amount payable for the rent of the equipment shall be the sum of the daily rate in respect of the equipment as set out in the schedule, multiplied by the number of days of the period of rental.

 

19. The 50% deposit set out in the schedule to confirm the booking will be payable by the customer on the date on which the order is confirmed. The balance of the rental shall be payable 24 hours before delivery of the equipment to the customer.

 

20. A refundable 25% damage deposit will be given by customer to be lodged as security for the rental of the equipment. The said deposit will then be payable back to the client on satisfactory full inspection of the rented equipment. All deposits must be paid and cleared 24 hours before delivery to event.
